Put players are flocking to ARM Holdings plc (ADR) (NASDAQ:ARMH) in today's session, as the stock pulls back from multi-year high territory. Roughly 3,000 contracts have crossed the tape as of 1:09 p.m. EST, or nearly nine times the average intraday pace for put options. As a point of comparison, just over 200 calls have traded. The lion's share of attention is centered around ARMH's April 39 put, which has seen more than 2,200 contracts trade. All of these have gone off at the ask price, and only 105 contracts currently make up open interest here, hinting at the initiation of new positions.

In order for these in-the-money puts to be profitable by April expiration, ARMH needs to drop 6.1% below its current price to breach the breakeven mark at $36.10 (the strike minus the volume-weighted average price [VWAP] of $2.90). Should the stock maintain its perch above this level over the next few months, the most the traders can lose is the initial net debit paid.

Today's trend in the options arena is a change of pace for speculators, who have been scooping up calls over puts at an accelerated clip in recent weeks. At the International Securities Exchange (ISE), Chicago Board Options Exchange (CBOE), and NASDAQ OMX PHLX (PHLX), traders have bought to open almost four calls for every put during the past 10 sessions. The resultant call/put volume ratio of 3.86 ranks higher than 72% of similar readings taken in the past year, suggesting a healthier-than-usual appetite for bullish bets over bearish throughout the last two weeks.

Technically, ARMH has been in a solid uptrend over the past six months, with the shares bouncing nearly 78% off their annual low of $21.64 -- which was tagged on July 17. What's more, the equity hit a 12-year high of $39.07 on Wednesday, Jan 2.

In light of this upward momentum, today's rush toward longer-term puts may be indicative of shareholders protecting their portfolios against any additional pullbacks over the next three months. In fact, by recording the new technical milestone on Tuesday, the stock broke through its upper Bollinger Band, suggesting ARMH was treading in overbought waters.

New U.S. food safety rules by FDA seek more accountability

(Reuters) - U.S. regulators proposed new food safety rules on Friday that aim to make food processors and farms more accountable for reducing food borne illnesses that kill or sicken thousands of Americans annually.

The rules, required by the Food Safety Modernization Act (FSMA) that was signed into law two years ago, were announced by the U.S. Food and Drug Administration on Friday.

The agency has come under heavy criticism for failing to introduce new food safety rules faster, but many of those critics applauded FDA's announcement.

"These proposed regulations are a sign of progress," said Caroline Smith DeWaal, food safety director at the Center for Science in the Public Interest, who has been a critic of the FDA. "The new law should transform the FDA from an agency that tracks down outbreaks after the fact to an agency focused on preventing food contamination in the first place."

Roughly one in six Americans suffers from a food borne illness each year, and about 3,000 die, the FDA said. The United States has had numerous outbreaks from food borne illnesses tied to salmonella, E. coli and listeria.

Food sickness has been linked to lettuce, cantaloupe, spinach, peppers and peanuts.

Under the new rules, facilities that manufacture, process, pack or hold human food to be sold in the United States, whether produced at a foreign or domestic facility, would have to develop a formal plan for preventing their products from causing food borne illness.

The rule would also require them to have plans for correcting any problems that arise.

Companies will be required to document their plans and keep records to verify that they are preventing problems. Inspectors will be able to audit the program to enforce safety standards, which should "dramatically" improve the effectiveness of inspections, said Michael Taylor, FDA deputy commissioner for foods and veterinary medicine.

"We're taking a big step for food safety by proposing the standards that will help us prevent food safety problems rather than just reacting to them," said Taylor. "Though many food processors already have documented food safety plans, the new rule sets requirements for "all firms across all commodities," he said.

A second rule proposes safety standard requirements for farms that produce and harvest fruits and vegetables. Among the requirements, farms would have to meet national standards for the quality of water applied to their crops, as water is often a pathway for pathogens.

Certain small farms would be exempt from most of the requirements.

The FDA will allow 120 days for public comment on the proposals.

Full implementation of the rules across food processors and farms will take several years, Taylor said.

Implementing the new rules will add costs for some food companies and farms, and the FDA will need additional financial resources for retraining inspectors and implementation, Taylor said.

The Food Safety Modernization Act was the first food safety overhaul in over 70 years in the United States and was signed into law in January 2011.

The proposals followed a series of meetings between FDA officials and consumer groups, corporate interests, researchers, and others.

Critics have charged FDA with dragging its feet in implementing the requirements of the new law. Last August, the Center for Food Safety, a nonprofit advocacy group, sued the FDA for missing several deadlines set under the law.

The standards for analyzing and documenting hazards were due last July, and the standards for safe production and harvesting of fruits and vegetables were due last January.

Within the next few months, FDA hopes to issue a proposed rule on preventative safety controls for animal feed as well as proposed regulations related to importer accountability for food safety.

The FDA is also setting requirements for the safe transport of food and hopes to have a proposal out later this year. It is also working to set standards to prevent intentional contamination of food.

"That is a very challenging area to figure out ... but we'll be working on that," Taylor said.

Congress also mandated FDA to improve the traceability of food and FDA is working with industry on a pilot study. FDA will issue a report on that work soon, Taylor said.

"There is plenty more in the pipeline," he said. "There will be more coming forward in 2013."

The Grocery Manufacturers Association, which represents more than 300 food, beverage and consumer product companies, said it was pleased to see FDA moving forward on implementing the two-year-old food safety law.

And the Consumers Union praised the new rules for going to the "heart of the problems" the United States has had with food safety.

But Center for Food Safety senior attorney George Kimbrell said it was disheartening that the agency did not issue these proposed rules until after the center filed suit to spur action.

"They are taking some action. But there are still several rules outstanding that they are behind schedule on," said Kimbrell. "This is a small part of a larger problem that is ongoing. There is a still a lot of work the agency has to do to comply with Congress' mandate."

Three women die as gunman opens fire in Swiss village

DAILLON, Switzerland (Reuters) - A gunman killed three women and wounded two men late on Wednesday in the Swiss village of Daillon, opening fire from his apartment then pursuing the attack in the street, Swiss officials said.

The 33-year-old gunman, who has not been named, threatened police when they tried to arrest him and was shot in the chest before being arrested and taken to hospital, police in the Swiss canton of Valais said on Thursday. No police officers were wounded.

The shooting is likely to stir a fresh debate about Switzerland's fire arms laws that allow its male citizens to retain guns after their mandatory military service.

The Daillon gunman was a local resident who had been in psychiatric care in 2005 and was unemployed and living on welfare benefits, police said. His only previous conviction was for marijuana use.

The village is close to the town of Sion, the capital of the canton - or region - of Valais, known for its world-class ski resorts such as Verbier.

The women who died, aged 32, 54 and 79, were all shot at least twice, in the head and chest. The youngest was married to one of the injured men and they had young children together, regional public prosecutor Catherine Seppey told a news conference. The injured men were aged 33 and 63.

Police said the gunman used at least two firearms - an old Swiss army carbine and a rifle capable of firing lead shot - even though his weapons had been seized and destroyed in 2005, and he was not currently listed as having any guns.

He began firing from his apartment, shooting at people in the street and in neighboring buildings, but later came out into the street, police said, adding that he appeared to have fired more than 20 shots.

Swiss website 20minutes.ch quoted villagers as saying the gunman had been drinking heavily. It also said he was armed with an assault rifle, but the public prosecutor did not confirm that information.

Swiss voters, backed by the government, rejected a proposal in February 2011 to tighten the country's liberal fire arms laws. Citizens outside the military can apply for a permit to purchase up to three weapons from the age of 18 in a country where sharp shooting and hunting are popular sports.

There is no national gun register but some estimates indicate that at least one in every three of Switzerland's 8 million inhabitants keeps a gun.

Many are stored in people's attics, a legacy of Switzerland's policy of creating a citizen army that can be mobilized quickly to defend its neutrality.

A shooting in the regional parliament of Zug in 2001 that caused 14 deaths prompted calls to tighten national laws.

But the majority of Swiss citizens rejected a proposal in 2011 for additional measures such as the creation of local arsenals for military weapons outside service periods.

Judge: Law won't protect unmarried victims in rape

LOS ANGELES (AP) ? A California appeals court overturned the rape conviction of a man who pretended to be a sleeping woman's boyfriend, ruling, in part, Wednesday that an arcane law from 1872 doesn't protect unmarried women in such cases.

A panel of judges reversed the trial court's conviction of Julio Morales and remanded it for retrial, in a decision posted Wednesday from the Los Angeles-based court.

Morales had been sentenced to three years in state prison. He was accused of entering a woman's bedroom late one night after her boyfriend had gone home and initiating sexual intercourse while she was asleep, after a night of drinking.

The victim said her boyfriend was in the room when she fell asleep, and they'd decided against having sex that night because he didn't have a condom and he had to be somewhere early the next day.

Morales pretended to be her boyfriend in the darkened room, and it wasn't until a ray of light from outside the room flashed across his face that she realized he wasn't her boyfriend, according to prosecutors.

"Has the man committed rape? Because of historical anomalies in the law and the statutory definition of rape, the answer is no, even though, if the woman had been married and the man had impersonated her husband, the answer would be yes," Judge Thomas L. Willhite Jr. wrote in the court's decision.

The appeals court added that prosecutors argued two theories, one correct and the other incorrect, and the case should be retried to ensure the jury's conviction is supported.

The decision also urges the Legislature to examine the law.

In 2010, a similar law in Idaho prevented an unmarried woman from pressing rape charges after being tricked into sex with a stranger by her then-boyfriend.

The judge called what happened "despicable" but said the state's law left the court with no choice. Idaho's law was amended to cover all women in 2011.

Morales' attorney Edward Schulman declined comment when reached by phone Thursday.

Prior to the conviction, Schulman had argued Morales believed the sex was consensual because the victim responded to his kisses and caresses, according to the decision.

#1. Social content is the ?new? king

Content has become mainstream as the foundation and cornerstone of social media marketing effort. Google has significantly changed the game by adding the social signals of the ?+1? button as an important part of determining what content to serve up and how it is indexed so it appears higher in search results.

Expect to see more content marketing tools, tactics and strategies that accept the fact that social, search and content are increasingly integrated and intertwined.

Content is still king but the shiny social media toys distracted us for a while from the importance of building content rich multi-media digital assets.

#2. Social at scale

Most people started to realize that despite the social networks being free to use, the resources required to play in the social media sandpit are substantial and can be expensive. Sourcing and creating content, publishing it and managing it are time consuming and require skills beyond finding interns who will work for free.

The big players are emerging such as Adobe Social, Exact Target and Salesforce.com (with its Radian 6 and Buddy Media acquisitions) realized doing social media at scale requires enterprise class platforms. They are providing the tools and platforms to this within the enterprise.

Twitter has captured the imagination of the younger generation and is no longer the enigma. It is indeed the new black and brands will be building focused Twitter tribes that extend and amplify their reach.

Twitter doesn?t filter its stream and as Facebook continues to censor your visible content to their ?pages? fans, Twitter is starting to look more attractive.

So expect brands to add to the social media toolkit a more vibrant and focused attention on Twitter.

You cannot ignore Twitter anymore in 2013.

#4. Social Dominatrix continues its grip

Facebook will continue to strengthen its grip as the de facto social network of choice as it builds mobile advertising and allows integration with apps and other platforms. Instagram will evolve to provide a means to mobile advertising for Facebook.

Despite the looming Google+ juggernaut, Facebook will continue to thrive. The platforms in one sense do not compete but complement.

You will need to get smarter at integrating Facebook commerce, build fans and grow your email list via custom tabs that offer exclusive content when liked.

So continue to keep an eye on developments with Facebook this year so that your marketing doesn?t become stale

#5. Visual as a social media weapon of mass destruction

Pinterest went from just being a fun way to share images to a serious traffic source and sales referer for online stores. Pinterest in some cases surpasses Facebook as a social media platform that creates real revenue and hard cash.

The visual social web is still rapidly evolving and is impacting web design interfaces and platforms. Sites such as Airbnb are offering Pinterest inspired platforms with compelling imagery that bypass traditional accomodation sites and also taps into the power of the social networks. Renting that spare room, bunglaow or cottage has never been easier!

Designing your website, blog and online stores now needs to include strong, large and high definition photos and images that are easy to share.
